ZENDRO CAPTURE

Terms of Service

Effective July 25, 2026

These terms are the agreement between you and Zendro LLC ("Zendro," "we," "us") for your use of Zendro Capture. Please read them. By signing up for or using Capture, you agree to them.

1What Capture is

Zendro Capture is a software service that connects to your lead sources — starting with Thumbtack — and uses an AI assistant to respond to your leads, hold a conversation in your business's voice, book jobs, and help you manage those jobs, bookings, and review requests. You stay in control: you can review the assistant's messages, jump into any conversation, and turn the assistant off at any time.

Capture is a tool that acts on your behalf and under your direction. You are the business the assistant represents, and you are responsible for the work you book and perform. Zendro does not provide any home, repair, or trade services, and is not a party to the agreements you make with your customers.

2Who can use it

You must be at least 18 years old and able to enter into a contract. You must give accurate business information at signup and keep it current — including the legal name, address, and entity details we need to register your messaging with the carriers. You are responsible for anything that happens under your account, so keep your login secure.

3Subscription, billing, and no contract

Capture is a monthly subscription. Your plan and price are shown at signup and in your account. Payment is handled by our payment processor, Stripe; by subscribing you authorize us to charge your payment method on a recurring monthly basis until you cancel.

No contract. There's no term commitment — you can cancel anytime, and your subscription ends at the close of your current billing period. We don't prorate partial months, and monthly fees already paid are not refundable except where required by law.

4Texting (SMS) and carrier registration

Your subscription includes the assistant working your Thumbtack conversations and, when you turn it on, texting your customers' real phone numbers. Turning texting on requires registering your business for application-to-person (A2P) messaging with the mobile carriers — a step we file and manage for you.

Texting setup and carrier registration are included in your subscription at no separate charge, whether you set texting up during onboarding or later. Registration timing is controlled by the carriers and typically takes a few days; your assistant keeps working your connected lead sources while registration is pending.

If you never turn on texting, you're never registered for A2P; the assistant still works fully through your connected lead sources.

5Messaging, consent, and your responsibilities

When you use texting, you are the sender of those text messages to your customers, and you are responsible for having the right to message each person you contact and for following the laws that apply to you — including the Telephone Consumer Protection Act (TCPA) and related rules. Capture is built to help you stay compliant: it messages people who contacted you first, it identifies your business, and it honors opt-outs (a customer who replies STOP is removed and won't be messaged again). You agree not to use Capture to send unsolicited bulk messages, or to contact people who have not engaged with your business.

You also agree not to misuse the service: no unlawful, deceptive, harassing, or infringing content; no attempt to break, overload, reverse-engineer, or gain unauthorized access to the service; and nothing that would put our carrier or platform relationships at risk.

6Third-party services

Capture works alongside services run by others — for example Thumbtack (your leads), Twilio (messaging), and Stripe (payments). Your use of those services is governed by their own terms, and their availability is outside our control. If one of them changes or restricts how it works with us, the way Capture behaves may change too.

7Your content and your data

You keep ownership of your business information and the conversations and records in your account. You grant us the permission we need to operate the service for you — to process, store, and transmit that content so the assistant can respond, book, and manage jobs on your behalf. How we handle personal information is described in our Privacy Policy.

The Capture software, its interface, and its underlying models and prompts are ours (or our licensors'). These terms don't give you any right to them beyond using the service.

8The assistant's limits

The assistant is capable, but it is software. It can misread a message or make a mistake. It won't invent prices, availability, guarantees, or policies you haven't given it, and it hands off to you when it's unsure — but you should review your conversations, especially early on. Decisions you make based on the assistant's messages are your own.

9Disclaimers and limitation of liability

Capture is provided "as is." To the fullest extent the law allows, we disclaim implied warranties, and we don't promise the service will be uninterrupted, error-free, or that it will produce any particular number of leads, bookings, or jobs. Any results we describe are examples of what happened for a specific business, not a promise of what will happen for you.

To the fullest extent the law allows, Zendro's total liability for any claim arising out of these terms or the service is limited to the amount you paid us in the three months before the claim, and we are not liable for indirect, incidental, or consequential damages. You agree to indemnify Zendro against claims arising from your use of the service, your messages to your customers, or your violation of these terms.

10Suspension and termination

You can cancel anytime by emailing support@zendrocapture.com. Cancellation takes effect at the close of your current billing period. We may suspend or end your access if you breach these terms, if your use creates legal or carrier risk, or if we're required to. If we end your access without cause, we'll refund any prepaid, unused subscription time.

11Changes to these terms

We may update these terms as the product grows. If we make a material change, we'll let you know (by email or in the app) before it takes effect. Continuing to use Capture after that means you accept the update.

12Governing law

These terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules, and any dispute will be handled in the state or federal courts located in Georgia.
